Purbeck District Council

The Local Land Charges Register is a local register (maintained by the District Council) containing details of restrictions or prohibitions on particular pieces of land, either to secure the payment of money or to limit the use to which the land can be put.  The Land Charge is binding on successive owners of the property.

 

Typically, during the course of the conveyancing process when a property is being purchased or leased, a solicitor or licensed conveyancer will usually search the District Council's Register to see if there are any entries affecting that property.  It could be important that issues arising from these are dealt with prior to exchange of contracts.

Applying for a Land Charge Search

You can register to use our on-line service free of charge at www.purbeck-dc.gov.uk/LLCWeb/Login.aspx, or alternatively use the link on the web page.  We offer an account service with this facility.

Expedited Searches

If you have an urgent search which you require to be returned within 3 working days, it may be possible to have your search expedited for an additional fee of £35.00.  Please telephone the Land Charges Section to make further enquiries regarding this service.

 

Refresher Searches

Refresher Searches are available at a cost of £35.00, subject to the following conditions:-

1.   Residential properties only.

2.   The request is submitted by the same applicant as the original search request.

3.   The search area is the same as the original search request.

4.   Within 6 months of the original search request.

5.   A maximum of 2 refreshers per property.

 

Turnaround Time

Our aim is to complete all standard land charges searches within 5 working days and fast-tract expedited land charge searches within 3 working days.

 

Cancellation of Searches

Please telephone the Land Charges Section if you wish to cancel a search request as it may be possible to issue a refund for the whole/part amount.  Generally if the search request is cancelled on the day of receipt before 10.00am then a full refund will be given.  If however, the search request is cancelled before the search is completed then a refund will be given based on work already undertaken by us.  If the cancellation is received once the search is completed then no refund will be given.

Personal Searches

Appointments to carry out a personal search of the Local Land Charge Register can be arranged between 10.00am and 3.00pm Monday to Friday.  To make an appointment please telephone the Land Charges Section.  Please be aware that we currently require 3 days' notice to ensure that all relevant information is available when you call. 

 

A plan clearly outlining the land/property must be faxed or emailed to Landcharges@purbeck-dc.gov.uk by 1.00pm on the working day preceding the search.  If no plan is received by this time then the search may be cancelled.

 

From 1 January 2010 the statutory fee for each personal search of the Land Charges Register is £22.00  and payment must be made by cash or cheque (made payable to Purbeck District Council) prior to the search being carried out.

 

The Land Charge Register is held on computer and searchers are able to view a printout of any entries.  However, this printout is not available to take away so searchers should be equipped to write any information they require.

The Land Charges Department also provides or facilitates access to unrefined data. Some of this is free being statutory or public information. The remainder is chargeable and the fees are clearly set out in the following costings and must be paid prior to the search being carried out.

Regulation 9(1) of the Local Authorities (Charges for Property Searches) Regulations 2008 require Local Authorities to publish a statement detailing access charges by the end of each financial year. The foregoing costings show the individual unit charges based on 1500 searches being made during the forthcoming financial year commencing 6^th April 2009. The estimate of total costs for granting access to this information to private searchers is the same as those applicable to internal transactions. The unit costs have been calculated on the basis that 1500 search requests will be received during the financial year
